3. EDUCATIONAL NATURE OF THE CONTENT

All information, sessions, programs, courses, videos, practices, exercises, articles, and other materials provided through ThatShakingGuy.com are intended for educational, informational, experiential, and personal-development purposes only.

They do not constitute medical, psychiatric, psychological, psychotherapeutic, physiotherapeutic, legal, financial, or other regulated professional advice, diagnosis, or treatment.

Nothing provided through ThatShakingGuy.com is intended to diagnose, treat, cure, or prevent any disease, injury, medical condition, psychiatric disorder, or mental health condition.

Participation in any offering does not establish a doctor-patient, psychologist-client, psychotherapist-client, psychiatrist-patient, physiotherapist-patient, or other licensed healthcare relationship.

Where appropriate, users and participants should seek advice from a suitably qualified healthcare or other licensed professional.

The separate Disclaimer published on ThatShakingGuy.com forms part of these Terms and should be read before participating in any body-based, emotional, breath, movement, neurogenic, bioenergetic, or somatic practice.

4. PARTICIPATION AND PERSONAL RESPONSIBILITY

Participation in all sessions, classes, courses, workshops, exercises, and practices is voluntary.

You are responsible for determining whether a particular activity is appropriate for you and for respecting your own physical and emotional limits.

Where relevant to safe participation, you agree to communicate information concerning medical conditions, injuries, pregnancy, medications, psychological conditions, or other circumstances that may affect your ability to participate safely.

You should inform the facilitator if you experience pain, dizziness, breathing difficulty, panic, dissociation, emotional overwhelm, or another reaction that may make continued participation inappropriate.

You may pause, modify, or discontinue participation at any time.

You must not force physical movement, shaking, tremoring, breathing exercises, emotional expression, or other practices in an attempt to achieve a particular result.

5. NO GUARANTEED RESULTS

Individual experiences vary.

GraceMethod Innovations LLC and ThatShakingGuy.com do not guarantee specific physical, emotional, psychological, relational, financial, spiritual, energetic, professional, or personal results from any session, course, program, product, practice, or other offering.

Testimonials, case examples, participant experiences, photographs, videos, or promotional materials represent individual experiences and should not be understood as promises or guarantees that you will achieve identical or similar results.

6. BOOKINGS AND APPOINTMENTS

Sessions, consultations, workshops, classes, and other scheduled services may require advance booking.

A booking is considered confirmed only after the applicable booking procedure has been completed and, where required, payment has been received.

Participants are responsible for providing accurate contact information and ensuring that they are available at the scheduled time.

Online sessions may take place through platforms such as Zoom, Google Meet, WhatsApp, or another communication service specified at the time of booking.

You are responsible for having an adequate internet connection and suitable equipment to participate in online services.

7. CANCELLATIONS AND RESCHEDULING

Cancellation and rescheduling conditions may vary depending on the service or program purchased.

Where specific cancellation or rescheduling conditions are displayed on a sales, booking, registration, or checkout page, those conditions form part of the agreement applicable to that purchase.

For individual appointments, reasonable advance notice should be provided if you need to cancel or reschedule.

Late cancellations, missed appointments, or failure to attend may result in the session being considered used and non-refundable, subject always to any mandatory rights available under applicable consumer law.

If we must cancel or reschedule a paid session, participants will normally be offered a replacement date, account credit, or refund for the affected service, as appropriate.

8. DIGITAL PRODUCTS AND ACCESS

Digital products may include e-books, recordings, courses, meditations, downloadable materials, membership content, videos, audio recordings, and other electronically delivered content.

Access instructions may be delivered immediately after purchase or through email, account access, or a third-party platform.

You are responsible for ensuring that the email address and other information provided during purchase are accurate.

Where technical problems attributable to us prevent access, you should contact us so that reasonable steps can be taken to restore access.

9. PAYMENTS

Prices are displayed before purchase and may be shown in USD, EUR, RON, or another currency depending on the offering and payment platform.

Payments may be processed by third-party payment providers.

By making a purchase, you authorize the relevant payment provider to process the transaction according to its own terms and privacy practices.

We do not ordinarily receive or directly store complete payment-card information entered into a third-party payment provider’s system.

Taxes, bank charges, currency-conversion costs, or payment-provider fees may apply depending on the transaction, your location, your financial institution, and the payment provider.

10. REFUNDS AND WITHDRAWAL RIGHTS

Refund eligibility depends on the nature of the product or service purchased, the conditions disclosed for the particular offering, and any mandatory consumer rights applicable to the transaction.

Where applicable law provides a statutory right of withdrawal, cancellation, refund, or other consumer remedy, nothing in these Terms is intended to exclude or restrict that right.

For digital content supplied immediately after purchase, delivery or access may begin before the expiration of an otherwise applicable statutory withdrawal period where permitted by law and where any legally required prior express consent and acknowledgement have been obtained.

Where applicable law requires confirmation of such consent or acknowledgement, it will be provided or recorded as required.

Duplicate payments, incorrect charges, or technical billing errors should be reported as soon as reasonably possible.

Any additional refund conditions stated on a specific sales, checkout, booking, subscription, course, membership, or program page form part of the terms applicable to that purchase, subject to mandatory applicable law.

11. SUBSCRIPTIONS AND MEMBERSHIPS

Some services may be offered through recurring subscriptions or memberships.

Where recurring payments apply, the frequency and amount of the payment will be disclosed before purchase.

Unless otherwise stated at the time of purchase, recurring subscriptions continue until cancelled.

You may cancel a recurring subscription using the cancellation method made available for the relevant service or by contacting us where appropriate.

Cancellation prevents future renewals but does not necessarily create a right to a refund for a billing period that has already begun, except where required by applicable law.

Access to subscription or membership content may end when the paid subscription period expires.

12. INTELLECTUAL PROPERTY

Unless otherwise indicated, original content made available through ThatShakingGuy.com—including text, educational materials, articles, graphics, photographs, logos, course materials, videos, audio recordings, exercises, presentations, written resources, downloadable materials, branding, and other original content—is owned by or licensed to GraceMethod Innovations LLC, Adrian Băjenaru, or another identified rights holder, as applicable.

Such content is protected by applicable copyright, trademark, and other intellectual-property laws.

Somatic Shaking™, together with associated original branding, educational materials, content, and proprietary materials, may be protected by applicable intellectual-property rights.

Use of the ™ symbol indicates a claim to trademark rights and does not, by itself, represent that a mark is federally registered unless expressly stated otherwise.

No purchase, booking, membership, or participation transfers ownership of intellectual property to the purchaser or participant.

13. PERSONAL LICENSE

When you purchase or receive access to educational or digital material, you receive a limited, personal, non-exclusive, non-transferable license to use that material for your own personal learning and development, unless different license terms are expressly provided.

Unless written permission has been provided, you may not:

  • reproduce the materials for distribution;
  • distribute or resell them;
  • upload them publicly;
  • share paid account access;
  • provide purchased materials to other people;
  • record or redistribute private sessions or classes;
  • use protected materials to create substantially copied or derivative competing commercial products;
  • claim our materials or proprietary methodology as your own;
  • teach, certify, license, or commercially reproduce proprietary course materials or methods solely because you participated in a course, training, program, or session.

Nothing in these Terms restricts any use that cannot lawfully be restricted under applicable copyright or other mandatory law.

14. RECORDING OF SESSIONS

You may not audio-record, video-record, photograph, screen-record, livestream, reproduce, or publicly distribute private sessions, group sessions, workshops, courses, or other protected educational content without prior permission.

Where an official recording is provided, it remains subject to the personal-use license and any additional conditions communicated with that recording.

If a session is recorded by us, participants will be informed where required, and any consent or other legal requirements applicable to the recording will be respected.

15. TESTIMONIALS AND MEDIA CONSENT

Testimonials, photographs, videos, recordings, or participant statements will only be used in accordance with the permissions, consents, agreements, and other lawful bases applicable to their use.

Permission to use an identifiable testimonial, photograph, video, or statement does not transfer ownership of unrelated personal information.

A participant may contact us regarding the continued use of testimonial or promotional material in which they are identifiable. Any request will be considered in accordance with applicable privacy law, contractual rights, and the scope of any permission previously granted.

16. PHYSICAL TOUCH AND CONSENT

Certain in-person somatic or movement sessions may involve physical touch where appropriate.

Physical touch will only be used with the participant’s clear and voluntary consent.

Participants may decline, modify, or withdraw consent for physical touch at any time without having to justify their decision.

17. COMMUNITY CONDUCT

When participating in groups, workshops, memberships, messaging communities, live classes, or other shared spaces associated with ThatShakingGuy.com, participants must behave respectfully toward others.

The following are not permitted:

  • harassment;
  • threats;
  • discriminatory abuse;
  • unwanted sexual behaviour;
  • deliberate disruption;
  • sharing another participant’s confidential or sensitive information without permission;
  • unauthorized promotion or spam;
  • recording other participants without permission;
  • distributing private group content outside the group without authorization or consent.

Access may be restricted or terminated where conduct materially compromises the safety, privacy, rights, or reasonable functioning of a community or where these Terms are seriously or repeatedly violated.

18. CONFIDENTIALITY AND GROUP PARTICIPATION

We may make reasonable efforts to create a respectful environment during private and group sessions.

However, we cannot guarantee that another participant in a group setting will maintain confidentiality or comply with these Terms.

Participants agree not to disclose another participant’s personal experiences, identity, images, statements, recordings, or sensitive information outside the group without appropriate permission.

Users should exercise appropriate discretion when sharing personal information online or within group environments.

19. USER ACCOUNTS

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account to the extent reasonably within your control.

Accounts and membership access are personal and may not be shared unless expressly permitted.

We may suspend or terminate access where there is reasonable evidence of:

  • unauthorized account sharing;
  • unauthorized distribution of protected content;
  • fraudulent activity;
  • abuse or harassment;
  • material misuse of the website;
  • serious or repeated violations of these Terms.

Any suspension or termination will remain subject to mandatory applicable consumer law.

20. THIRD-PARTY SERVICES AND LINKS

ThatShakingGuy.com may use or link to third-party services, including payment processors, scheduling platforms, video-conferencing platforms, email services, social networks, external websites, and other technology providers.

These third parties operate under their own terms, policies, and privacy practices.

To the extent permitted by applicable law, we are not responsible for the independent content, availability, policies, security practices, or actions of third-party websites or services that are outside our reasonable control.

21. WEBSITE AVAILABILITY

We aim to keep the website and digital services reasonably available but cannot guarantee uninterrupted or error-free access.

Temporary interruptions may occur because of maintenance, hosting problems, software failures, third-party outages, cybersecurity events, internet disruptions, force majeure events, or other circumstances beyond our reasonable control.

Where appropriate, reasonable efforts will be made to restore access.

Nothing in this section limits any mandatory rights or remedies that may apply where a purchased digital service or digital content does not conform to applicable legal requirements.

22. PROHIBITED USE

You may not use ThatShakingGuy.com:

  • for unlawful purposes;
  • to interfere with website security or normal operation;
  • to attempt unauthorized access to accounts, data, or systems;
  • to copy or scrape protected content for unauthorized commercial redistribution;
  • to impersonate another person or misrepresent your identity;
  • to distribute malware or harmful code;
  • to infringe intellectual-property rights;
  • to harass, threaten, or unlawfully harm another person;
  • to misuse paid materials, subscriptions, or access credentials.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GraceMethod Innovations LLC, ThatShakingGuy.com, and their respective owners, officers, contractors, facilitators, or service providers will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use or misuse of the website, educational materials, digital products, or services, except where such liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or any other liability that cannot legally be excluded or limited under applicable law.

Nothing in these Terms excludes or restricts any mandatory consumer right or remedy.

Users remain responsible for applying educational information appropriately, respecting their own limits, and seeking qualified professional assistance where necessary.

24. PRIVACY AND COOKIES

The collection and processing of personal information through ThatShakingGuy.com are governed by the website’s Privacy Policy.

Cookies and similar technologies may also be governed by the website’s cookie notice and consent-management system.

Where applicable law requires consent before non-essential cookies or similar technologies are activated, such technologies will be used in accordance with the choices made through the applicable consent mechanism.

When users choose to interact with third-party services integrated with or linked from the website, information may also be processed by those providers according to their respective privacy policies and applicable law.

25. CHANGES TO SERVICES AND PRICES

Offerings, schedules, availability, formats, prices, instructors, facilitators, course structures, and website content may change over time.

Any price change will not retroactively alter a transaction that has already been completed unless otherwise agreed or required by law.

For recurring subscriptions, any change affecting future charges will be communicated or implemented in accordance with the terms disclosed for that subscription and applicable law.

26. CHANGES TO THESE TERMS

These Terms & Conditions may be updated from time to time to reflect changes in our services, business practices, technologies, or legal requirements.

The latest version will be published on this page together with an updated effective date.

Changes will apply prospectively from their effective date unless applicable law requires otherwise.

Where applicable law requires specific notice or consent for a material contractual change, the required notice or consent will be obtained.

27. SEVERABILITY

If any provision of these Terms is found by a competent authority to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Where legally possible, an invalid or unenforceable provision will be interpreted as closely as possible to its intended lawful effect.

28. GOVERNING LAW AND CONSUMER RIGHTS

These Terms are governed by the laws of the State of New Mexico, United States, without prejudice to any mandatory consumer-protection rights that apply under the laws of a consumer’s country of habitual residence and that cannot lawfully be excluded, restricted, or waived by agreement.

Nothing in these Terms is intended to exclude, restrict, or remove any consumer rights or legal protections that cannot lawfully be waived or excluded under applicable law.

Where a dispute arises, the parties are encouraged to first attempt to resolve the matter directly and in good faith by contacting us at [contact@thatshakinguy.com](mailto:contact@thatshakinguy.com).

Nothing in this section prevents a consumer from exercising any right to bring a claim before a court, tribunal, consumer-protection authority, or other competent body where such a right is provided by mandatory applicable law.
